Adoption

Adoption is the legal process by which an individual or couple becomes the legal parents of a child, permanently transferring parental rights from the child’s biological or legal parents to the adoptive parents. In Alberta, adoption is regulated under the Child, Youth and Family Enhancement Act to ensure the child’s best interests are protected.

Note: The primary goal of adoption is to provide a stable, loving, and nurturing environment for children who cannot live with their biological parents.

Types of Adoption

  1. 1. Public Adoption – Adoption of a child under the care of the Alberta government. These children are usually removed from their biological parents due to neglect, abuse, or unsafe conditions.
  2. 2. Private Adoption – Voluntary placement of a child by birth parents with adoptive parents through a licensed adoption agency.
  3. 3. International Adoption – Adoption of a child from another country, requiring compliance with Alberta’s laws, the laws of the child’s country of origin, and international adoption treaties.
  4. 4. Kinship or Step-Parent Adoption – Adoption of a relative or step-child, generally involving a simplified process due to the existing relationship between the child and adoptive parent(s).

Adoption Process

  1. 1. Information Session – Prospective adoptive parents must attend a session explaining the adoption process, challenges, and rewards.
  2. 2. Application – Submission of an application including personal details, reasons for adoption, and the type of child they are willing to adopt.
  3. 3. Home Study – Assessment involving interviews, home visits, reference checks, medical reports, and criminal record checks to determine suitability.
  4. 4. Training – Prospective parents must undergo training to understand the needs of an adopted child and prepare for challenges.
  5. 5. Matching – Once approved, adoptive parents are matched with a child. In private and international adoptions, birth parents or foreign adoption authorities may be involved in the selection.
  6. 6. Placement – The child is placed with the adoptive parents under supervision to ensure a successful transition.
  7. 7. Finalization – The court legally finalizes the adoption, granting the adoptive parents full parental rights and responsibilities.
