Areas Of Immigration Law

IMMIGRATION PERMITS WITHIN CANADA

Canada has built a reputation for embracing immigrants with open arms and valuing multiculturalism for nearly a century. Foreign-born people make up around a quarter of Canada’s population, the largest proportion among industrialised Western nations.

However, applying for immigration permits on your own can be a time-consuming and unpleasant process. As a result, we provide a variety of services to make the process as simple as possible for you.

Some of the most common types of permits within Canada are: –
  • Spousal Visa: If you are married to a Canadian citizen or permanent resident, you may be eligible to apply for a spousal visa. This visa will allow you to live in Canada with your spouse and any dependent children.
  • Study Permit: If you want to study in Canada, you will need to apply for a study permit. This permit will allow you to stay in Canada for the duration of your studies.
  • Work Permit: A work permit allows you to work in Canada for a specific employer and for a specific period of time. If you are looking for a job in Canada, you will need to apply for a work permit first.
  • Permanent Resident Card: A permanent resident card is your proof that you are a permanent resident of Canada. If you lose your card, or it gets stolen, you will need to apply for a new one.
There are many other types of permits, each with its own specific requirements. If you would like more information on the different types of permits available, please contact us.

TEMPORARY RESIDENT PERMITS (TRP)

A TRP is a temporary pass that allows US citizens and permanent residents to visit Canada for a limited time. Depending on the applicant’s demands, the rationale for the issuance of a TRP might range from job to emergency to family.
The length of your TRP will be determined by your requirements. A temporary resident permit, on the other hand, is only valid for three years. Our Calgary immigration lawyers and IRCC certified consultants will assist you in obtaining the most favourable TRP terms for your specific circumstances.

CANADIAN WORK PERMITS

Canada continues to accept work permit applications from temporary workers, IEC participants, and anyone interested to work in Canada. A Canadian work permit grants you permission to take up a job in Canada.
Laws & Beyond will help you secure a work permit by ensuring that you have met all its eligibility requirements. Generally, your work permit application will follow the following process:
  • Your employer will have to apply for Labor Market Impact Assessment
  • The employer then extends a Temporary Job Offer
  • You are then required to apply for a Work Permit
  • Your Work Permit is issued
We have helped clients find job in Canada without a permit on a few instances. We have assisted international students who have completed their studies at Canadian universities in obtaining a Post-Graduate Work Permit.
An Intra-Company Work Permit program allows Canadian companies with operations abroad to transfer staff to Canada.

CANADIAN VISITOR VISAS

A visiting visa is sometimes known as a Tourist Visa or a Temporary Resident Visa. Any visiting visa holder is welcome to visit Canada at any time. Your tourist visa has an expiration date, which you can extend by submitting an online application with a valid reason.

We’ll take care of your Visitor Visa application so you can join the 35 million tourists that visit Canada each year. With a Temporary Resident Visa, you can take advantage of Canada’s wealth of opportunities.

There are four types of Canadian Visitor Visas:
  • Tourism/ visit
  • Work
  • Study
  • Temporary residency
The duration of your TRV will vary depending on a number of factors. In most cases, a Visitor Visa will have an expiry period of six months. However, our immigration professionals can reason with the issuing authority on your behalf for an extended TRV.

RESTORATION OF STATUS

To remain lawfully in Canada when your temporary residence status expires, you must apply for status restoration within 90 days. Fortunately, you do not need to be concerned because our immigration attorneys at Laws & Beyond will assist you in regaining your legal status.
We can also assist you in applying for an extension of your temporary residence status if it is about to expire.
In other situations, Section 47 of the Immigration and Refugee Protection Act may cause you to lose your status. In that situation, we would assist you in filing an application for reinstatement of your status under Section 182 of the Immigration and Refugee Protection Regulations.

CRIMINAL REHABILITATION

Individuals who are inadmissible to Canada can apply for Criminal Rehabilitation through the Canadian government’s immigration department.
People who are still eligible for permanent clearance of previous criminal records can take advantage of the offer. If you were convicted of a crime in another country and have served your sentence for more than five years, you may be eligible for criminal rehabilitation in Canada. We will walk you through the legal procedures if you are interested in applying for criminal rehabilitation.

CANADIAN SPONSORSHIPS

As a country that is devoted to supporting family reunion, Canada offers many immigration schemes that allow Canadians an opportunity to sponsor family members to Canada.
Permanent Canadian citizens who want to bring their loved ones to Canada can take advantage of these sponsorship opportunities.
If you are a Canadian citizen or permanent resident, our immigration specialists can assist you in using this immigration vehicle to bring your immediate family and spouses to Canada faster.

SPOUSAL SPONSORSHIP

For the purposes of this program, the meaning of the term spouse includes the following groups of people:

  • Spouses that are legally married as per the Canadian Laws.
  • A common-law partner or conjugal partner with at least one year of cohabitation and a conjugal relationship.
  • Couples that have dependent children together.
We have assisted our clients in sponsoring their spouses for permanent residence in Canada, whether they are living in Canada or abroad on a valid temporary visa. If your spouse is currently in Canada on a temporary basis, we can assist them in applying for an Open Work Permit, which will relieve you of some of their financial obligations.

DEPENDENTS SPONSORSHIP

When applying for permanent residency in Canada, you can include your children as accompanying dependents. When moving to Canada for the first time, though, you may not be able to bring your children with you.
If you left your children in your home country, we can assist you in obtaining sponsorship for them through Canada’s child sponsorship program. Permanent residents and citizens of Canada can sponsor their biological and adopted children under the age of 22 for permanent residence.
If you have intellectually or physically challenged children above the age of 22, we can assist you in obtaining permanent residency in Canada for them.

PARENT OR GRANDPARENT SPONSORSHIP

Canada’s mission to foster reunification of families extends to parents and grandparents of Canadian permanent residents and citizens. Our immigration team will help you bring your old folks to Canada through the Parents and Grandparents Sponsorship Program.
However, for a Canadian citizen or permanent citizen to sponsor a parent or grandparent, they must first prove that they are capable of supporting the family financially by meeting the Minimum Necessary Income (MNI).
You must also agree to support the sponsored family members financially when needed. In the event that you cannot support the sponsored family member financially, continuously, then we will help you apply for a Super Visa.
A Super Visa is typically a long-term multi-entry visa for grandparents and parents to Canadian permanent residents and citizens.

EXPRESS ENTRY

The quickest, easiest, and most popular way to get permanent residency in Canada is through an Express Entry application. Every year, the Canadian government accepts approximately 110, 000 foreign employees through the Express Entry program.
If you are a skilled worker and wish to immigrate to Canada with permanent resident status, we can help you secure an Express Entry. This system manages a total of three federal economic programs, namely:
  • Federal Skilled Trades (FST)
  • Federal Skilled Worker (FSW)
  • Canadian Experience Class (CEC)
If you have a college or university degree, you are eligible for the Express Entry application. Additional requirements for this application included skilled work experience and moderate proficiency in English or French. Our immigration professionals will help you assess your eligibility under the three federal programs.

INVESTOR/ ENTREPRENEUR & SELF-EMPLOYED IMMIGRATION

Depending on their needs and circumstances, those who want to immigrate to Canada under the business immigration category have many possibilities. The major goal of Canada’s business immigration programs is to attract those who have demonstrated entrepreneurial abilities and expertise.
The Canadian government is dedicated to fostering the growth of a strong and sustainable economy, which includes encouraging expatriates to consider making Canada their permanent home. You must, however, show that you have previously experienced business success and that you can reproduce that success in Canada while adjusting to the Canadian business environment.
Depending on your unique circumstances, our immigration attorneys will help you move to Canada under any of the following classes:
  • Investors: We will help you apply for the Immigrant Investor Program, which focuses on attracting seasoned business professionals who can make a significant investment in the Canadian economy.
  • Entrepreneurs: The Immigrant Entrepreneur Program is designed for individuals with strong business experience willing to own and actively manage businesses in Canada, employing Canadian locals.
  • Self-Employed Persons: This immigration program aims to attract individuals wishing to self-employ themselves in Canada.
These business professionals are always welcome in Canada since they often bring tremendous benefits to Canada’s economy. Our immigration lawyers and consultants will advise you on the best business immigration category for your unique needs.

HUMANITARIAN & COMPASSIONATE CASES (H&C)

The H&C is a Canadian permanent residence application that can be submitted from anywhere in the country. This program is exclusively available to people who are undocumented in Canada. If you or someone you know is in Canada without the necessary documents, you may be eligible for a Humanitarian and Compassionate application for permanent residence.
Our immigration lawyers and advisors at Laws & Beyond will assist you in applying for and obtaining permanent residency in Canada via the H&C program. You should be aware, however, that the H&C is not a program for those seeking protection.
Our lawyers and consultants will guide you through the process of obtaining refugee status in Canada if you are seeking protection from danger, harsh punishment, or prosecution.

REFUGEE CLAIMS

We can assist you in applying for refugee status in Canada if you fulfil the international law definition of a covenant refugee. This program is also open to anyone who want to avoid being prosecuted or punished in an unethical way.
We will assist you in filing a claim, and your case will be referred to the Immigration and Refugee Board of Canada’s Refugee Protection Division if you qualify. The RPD will decide whether you qualify for refugee status after listening to and evaluating your situation.

CANADIAN CITIZENSHIP

Citizenship is frequently the ultimate objective for most permanent residents in Canada. We will assist you with all legal formalities if you believe you have been through the immigration process for years and seek to obtain official Canadian citizenship.
Before your Canadian citizenship application is granted, you must be vetted by the Immigration, Refugees, and Citizenship Canada board. Consider working with one of our experienced immigration lawyers for a simple and stress-free process.

IMMIGRATION APPEALS AND JUDICIAL REVIEWS

If you are unhappy with an immigration decision, you have the right to appeal to the Federal Court of Canada for a judicial review. You should be aware, however, that reviews and appeals are subject to strict legislative limitations and timeframes.
For example, if the Immigration and Refugee Board (IRB) denied your refugee claim, you must file a lawsuit in Federal Court within 15 days of the IRB’s judgement. Our experienced Canadian immigration lawyers and IRCC certified consultants will assist you in obtaining a favourable judicial review or appeal.

Procedural Fairness

Decision-makers in the Canadian immigration department must abide by statutory rules of procedure through all decision-making processes. According to Canadian laws, procedural fairness requires that all applicants:
  • Receive a fair and unbiased assessment
  • Be informed about the decision-makers’ concerns, and
  • Be allowed a chance to provide a response concerning said concerns about their application.
If you feel that immigration officers have contravened these procedural fairness rules, we can help you seek the most relevant legal remedies.
