Although there are some exceptions, you must file your Civil Claim or Statement of Claim with the Court within two years of the occurrence of the event. For instance, if you were in a car accident on April 30, 2020, you must file your Statement of Claim with the court by April 29, 2022.
Furthermore, after filing your Civil Claim or Statement of Claim, you must promptly serve the Defendants to notify them that they are being sued.
If your claim is for less than $50,000.00, you should file it in Alberta’s Provincial Court. The Provincial Court process has fewer procedural steps and is usually less expensive than the Court of King’s Bench process. However, in certain circumstances, you must file you must file with the Court of King’s Bench, even if your claim is less than $50,000.00. For instance, in order for a builder’s lien to be enforced, a Statement of Claim must be submitted at the Court of King’s Bench, and a Lis Pendens must be registered.
Any claims in excess of $50,000.00 must be filed with the Alberta Court of King’s Bench.
